Kevin Benoit of Sheaves Cove pleaded guilty to two of the four charges he faced in provincial court in Stephenville on Friday.
Crown Attorney Kari-Ann Pike and Benoit's lawyer Fred Stagg agreed to a plea bargain arrangement that saw the other two indictable charges dropped and Benoit released from custody.
Benoit pleaded guilty to charges possessing a weapon or imitation for a dangerous purpose and uttering threats to cause death or bodily harm. The charges to be withdrawn, if Judge Jacqueline Jenkins agrees to it, are pointing a firearm and assault with a weapon or imitation.
The charges stem from an incident in Sheaves Cove earlier this year when Benoit threatened Gerard Smith, another resident of Sheaves Cove.
Jenkins ordered Benoit to return to court in Stephenville on Feb. 2, at 2 p.m. for facts and sentencing on the charges he pleaded guilty to, a pre-sentencing report and trial.
She said the matter of seven failures to comply with conditions of an undertaking or recognizance will be dealt with at that time.
There were a number of conditions placed on Benoit, including he keep the peace and be of good behaviour; remain in the province unless approved to leave by the RCMP.
He is to remain in his place of residence from midnight to 7 a.m.; notify the RCMP within 24 hours of any change in his address; refrain absolutely from any contact or communication, direct or indirect, even if invited, with Gerald Smith or members of his immediate family, Wilbert Jesso, Shelley Jesso or Travis Young; as well as not entering the properties of these people.
Benoit is not to have contact with persons having a criminal record, with the exception of members of family, household or school. He also has a firearm and ammunition restriction. He was ordered to report to the RCMP on Tuesdays to sign the attendance sheet.
