Teacher acquitted on sex charges

A provincial court judge believes there were inappropriate conversations between Lloyd Whitehorne and a 13-year-old girl, but felt the Crown had not proven beyond a reasonable doubt there was any physical contact between them.

Lloyd Whitehorne, an elementary school teacher from Port aux Basques alleged to have had an intimate relationship with a 13-year-old girl, has been acquitted of charges of sexual assault and sexual interference.

Judge Catherine Allen-Westby delivered her decision on the case in provincial court in Corner Brook Monday morning, one month after a three-day trial in early September.

The judge believed there were inappropriate conversations via electronic devices between Whitehorne, 41, and the young girl and that he did nothing to discourage those conversations from continuing. At trial, Whitehorne had denied he had sent some of those messages, which indicated plans for the two to meet secretly.

However, Allen-Westby said there was reasonable doubt about whether any inappropriate physical contact had ever taken place between the two. The judge based that decision primarily on inconsistencies between what the girl had told police and her testimony in court during the trial.

    @ SALLY I'm not defending this man in any way, but I just wanted to point out that just because an accuser, doesn't matter what age, continues with the long process of a trial and sees it through, that does not mean that there has to be truth in their claim.

    I think this to be a very sad day for that dear little girl who have had to go through 2 years of this. Why would she continue with this long process if there was no truth. I am so disappointed in our court system. No one will pay any attention to the judge saying she did believe there was correspondence between the two but only on the fact that he is aquitted. Why did he correspond with a 13 year old?? Where does that leave the parents of St. James Elementary where he will now teach again. He is not to be trusted around young girls and yet we will let him go in a classroom full of young kids. I think something should be said about that.

    Ok, so the judge felt there was reasonable doubt as to the physical actions - doesn't mean he's innocent, just that there were questions raised. But where does this leave the children he will probably once again teach. He had very inappropriate, sexual conversations with a young girl. Will the school board allow this kind of behavior and permit him to return to working in an elementary school??? This should raise some huge questions for the parents and administration of the school. We need to protect our children.

      I am a formed student to Mr. Whitehorne's and i current still live in the community where he teaches. I completely disagrees with what you have to say. If the judge dropped the charges and let the man go free shouldn't he be alllowed to move on with his life to and be able to teach again. Which being a former student I can say that this man is a wonderful teacher and i learned a great deal by being in his classes. My daughter is just starting school at this elementary school where he teaches and I would have no problem with him teaching her. Unless you are from this community and have met Mr. Whitehorne or been taught by him how can you honestly sumit a comment on what you think. People should never be so quick to judge other people.
