Changes needed at Workers' Compensation case worker level: consultation attendees

CORNER BROOK  Two men spoke out for their wives on Thursday in hopes it will make a difference and that others won’t have to suffer the way they have.

“Workers’ (compensation) hurts. It’s been our experience that workers hurts, not helps,” said Glenn Sharpe outside a public consultation held as part of a statutory review of the Workplace Health, Safety and Compensation system.

Sharpe and Gary Sheppard attended the consultation at the Mamateek Inn in Corner Brook to share their stories with the review committee responsible for preparing a report for government.

Those stories contained several similarities. Both of their wives worked in the retail sector, both women were injured on the job and both have had negative experiences with the workers’ compensation system, including having their benefits cut. Both are still unable to work.

Sharpe and Sheppard feel case workers need to be held more accountable. Sharpe said he had concerns information passed along by his wife Julia was not correctly processed.

“Very important information being left out, in my opinion,” he said. “It hurt her. It cut benefits, it cut off her compensation.”

Julia was injured on the job in 2007 and since then has had six case workers.

“The way that she was treated by those case workers, neglect is the only word you can use basically.”

He said his wife even begged for more physiotherapy because she felt it was helping her. Instead, she was told to have surgery, but it didn’t work.

Sharpe said all meetings and conservations between clients and case workers need to be recorded, and decisions made based on that.

“What they portray in their notes, it hinges on being criminal. It’s not correct. They take a report and take what they want out of the report to benefit them. Not to benefit the worker.”

Overall, Sharpe said it’s time to change the legislation and to stop hiding behind it.

Sharpe and his wife sat through the majority of the day’s presenters and said they heard the same things from others.

“It was an echo, the same stories over and over.”

Stories like that of Sheppard and his wife Violet.

Sheppard said his wife has to have 30 to 40 needles in her hip every three months, but getting approval for that has never been easy.

“She’s got to phone her caseworker to beg to go get those needles before they’ll do anything.”

With tears in her eyes, Violet Sheppard said she believes the case workers and system do things “just to make it painful.”

She was told she could return to work for four hours a day, but knows she’s not ready. So in November, her benefits were cut.

Sheppard said it’s wrong that case workers can override a doctor’s opinion.

“Where did they get the training to do it,” he asked.

Sheppard said he knows just where his wife is coming from. He suffered a workplace injury in the past and the treatment hasn’t changed from then until now.

“I would never report another injury,” he said. “Even if I had one leg in the grave and the other one was on a banana peel, I’d die before going back to workers.”

    Workers certainly do not seem to be there to help, they like to spend money but it's in my opinion not spent where it's needed.. They would much rather send you off to the place of their choice to have you assessed and most likely cause more pain and setback than allow you the time to heal. A place where it doesn't matter if you break a finger or have a slipped disc they will put you through the same program. This "wonderful" empower program that I'm sure many are familiar with, it's praised by case managers but in fact out of everybody I've talked to that's been there (except one) the opinion is quite the opposite. And why is this place most recommended by them?... Hmmm Workers seem to have the idea as well that you must be going to physio or chiropractic treatments or else you don't want to get better. Realistically not all injuries benefit from this and even doctors would have to admit that for at least some injuries there is no proof that these treatments even help. I'm not saying that it can't help, I just think that each case needs to be handled in the appropriate manner and not to just put you in a situation that may possibly cause more pain and suffering. The bully tactics really need to stop, what gives them the right to cause further pain and stress. You try to look out for yourself and do what you feel will help most in the long run and they threaten to cut your benefits. I think you would have to be rather unstable to want to be on workers being talked to like a child and stressed to the max. I personally don't think much of being trapped in a situation where you can't return to a job you actually did love doing and not being able to do much else because one slight wrong move and you could be off your feet for a week or more in absolute agony.. I met one person who was also attending physio that was pushed into surgery for a disc, the surgery was unsuccessful due to damaging two more disc's. His surgeon wrote a letter stating he would not be doing anymore surgeries on this person. Workers comp apparently didn't like this and said they have their own doctor that will make sure the surgery goes ahead. Are they trying to kill people off? I guess they wouldn't have to pay then.. I can't even believe the mentality, absolutely disgusting when you think about it. Maybe some fresh faces in workers comp would help, the current ones I've dealt with have very poor people skills.. There was one a while back that was good but of course she's no longer working there...

    To add to what I already said.I can't do the work I use to do but I consider my self young enough to have another Career but I don't have the training nor the money to go back to school .I worked full time and have been out of school for 31 years . I asked an employer at this review knowing my history would you hire me he said no I would be a liability right off the bat

    While there are many legitimate Workers Claims, it's the ones that are not so legit that make it bad for everyone else. The ones that can't work because they have a bad neck or shoulder but can post pics on Facebook of themselves on skidoo, playing sports etc. It's those people that make it bad for the real Workers Claims. Maybe more investigators are needed to look into the "claims". Hope everyone who truely needs Workers is able to get it!

    I totally agree that workers comp is there to hurt the injured workers I have been injured since 2006 and its been a battle for me I have had herrings and appeals for 2 years without getting any pay and I won my case and its not a year since they started paying me again and they are already on my back to go for a functional assesment so they can clear me for 4 hours just so they say I can work we all know that these test are worthless I dont know anyone that has not been cleared for atleast 4 hours a day this is becasue this is the requirement for them to cut you off. They lie and sceem and twist words around so they benifit, I have seen 3 speciaist to physiotherapist and my oen docter ever month who clearly states I am unable to work at anything and they are stilll pushing me to get this assessment done to see if they can get me cleared for work. My life has been a living hell because of them and those case managers dont even know proper policies and think they have the right to dictate what you do which I found out was wrong at my hearing , they are selfish and careless people my wish is that one of them be put in the same boat and have someone calling them all the time and threatning to cut off their pay how would they like it. It has had a very negative affect on my life its a constant battle, wish I new this meeting was going on at the Glynmill Inn because I would have loved to attend and express my concerns on the workers comp system ,

      You are another one telling my story.when I knew that they were coming a bunch of us did many things to let the public know but a lot of people are afraid and are uncomfortable doing so like myself.Like my self I have another reason not to speak out right now if you want some support please email us on the email provided.In some cases as I heard yesterday the employer are not supportive either so you have double whammie.you have until April 3rd I think to summit on paper what you have experienced that is just as good or better cause in this review you had only 15 mins to talk how could you put 5 years of hell in a 15 min review.they still have a few places in nl to go so if your going to be in any of these locations you can speak.

    welcome to the world of "worker's" comp. Of course they didn't help them....those people have one goal....claw back from the workers as much as they can.
