CORNER BROOK A junior high school teacher in Corner Brook who pleaded guilty to assaulting his former spouse has been given a conditional discharge in provincial court.
Brian David Penney, 47, was in court for sentencing Thursday afternoon.
Judge Wayne Gorman agreed with defence lawyer Robby Ash’s submission that Penney should be granted a conditional discharge, which means no conviction will be registered on Penney’s criminal record as long as he abides by the conditions set out by the court.
Penney, who was also given 12 months of probation, was involved in a domestic dispute with his estranged wife in September 2012.
Crown attorney Lori St. Croix had asked for 60 to 90 days in jail, agreeing that Penney could have served such a sentence on weekends. The Crown also sought 18 months of probation.
