UPDATE: Youth accused of assault with a weapon released

CORNER BROOK  A 13-year-old boy was released back to the custody of his mother Tuesday, but is not permitted to have contact with certain other members of his family after he was charged with assault with a weapon.

According to the Royal Newfoundland Constabulary, police responded to a complaint of an assault at a residence on the west side of Corner Brook at around 5 p.m. Monday.

The allegation was that a 13-year-old boy had threatened a 15-year-old boy with a knife. Const. Scott Mosher, the RNC’s media relations officer, told The Western Star that both boys were known to one another and neither one was injured in the incident.

In provincial court early Tuesday afternoon, the 13-year-old made a brief court appearance and was released on conditions agreed to by Crown attorney Adam Sparkes and legal aid duty counsel Peter Chaffey. Those conditions included the youth not having any communication with a list of people that included family members.

The court was assured that the related family members on the list would not be residing in the same household and, where applicable, would not be attending the same school as the accused.

Judge Kymil Howe made an exception to the conditions in order to permit the relatives to attend counselling sessions together, if that was required.

The conditions also included a weapons prohibition. When asked by the judge, the teenager said he did not own any knives.

The youth has been charged under section 267 (a) of the Criminal Code of Canada, which stipulates that anyone who “carries, uses or threatens to use a weapon or an imitation thereof” in committing an assault can be charged with the offence of assault with a weapon.

The boy had his next appearance set for youth court March 5.

CORNER BROOK  A male youth offender is expected to appear in provincial court in Corner Brook this morning facing an assault with a weapon charge.

The Corner Brook Royal Newfoundland Constabulary reported the charge in its overnight police report this morning. Const, Scott Mosher said, at about 5 p.m. Monday officers responded to a complaint of an assault at a residence on the city’s west side. It was alleged a 13-year-old boy threatened a 15-year-old boy with a knife. Both males were known to one another and neither sustained injury, reported police.
