Deer Lake man gets six months for breaking into vehicles

A 28-year-old Deer Lake man was sentenced to six months in jail on Tuesday for breaking into vehicles in the town over a three-month period in 2013.

Brian Joseph Sutherland had pleaded guilty to two counts of theft, three counts of mischief involving interference with the use of property, two counts of a breach of undertaking and a breach of probation.

Judge Wayne Gorman handed down Sutherland’s sentence in provincial court in Corner Brook and provided a brief overview of his written decision to the court.

From April 17 to July 16, 2013 Sutherland entered between 10 and 12 vehicles in Deer Lake and stole money and a pair of binoculars.

In court, Gorman spoke of the circumstances of Sutherland. He said Sutherland was born in Nova Scotia and moved to Deer Lake when he was six years old.

He said the pre-sentence report completed on Sutherland indicates he has had long-standing addiction issues.

The report also says that for the first time, Sutherland does not minimize the details of his substance use.

However, Gorman went on to point out that the report also says Sutherland reluctantly agreed that his is addicted to Percocet.

The report also says that Sutherland appears to be at the stage where he recognizes that he has a problem with alcohol and Percocet, but is not prepared, or is unable, at this point, to deal constructively with these issues.

Sutherland has been in custody since July 9 and was given six days credit for time served.

At the completion of his sentence he’ll have to serve a period of two-years probation.

Conditions of his probation include, he report to a probation officer as required and that he comply with all directions from his officer, including attending all counselling or treatment sessions arranged by his probation officer.

The victim fine surcharge was waived in this case as the charges against Sutherland pre-date a change in legislation making the fines mandatory.
