Bail hearing set for Tuesday

ST. JOHN’S — A man missing and believed to be dead for more than two years appeared in provincial court in St. John’s Sunday.

Bruce Ives Leyte, 57, was very much alive when he was escorted into courtroom No. 7 in St. John’s Sunday morning. Sitting stoop shouldered in a leather jacket, striped shirt and jeans, Leyte said nothing, but looked considerably older than the photo of him printed in The Telegram and The Western Star Saturday.

The photo and story were based on a news release issued by a British Columbia detachment of the RCMP that suggested Leyte could be living in the Lumby/Cherryville area of that province.  But police officials in this province say Leyte was arrested around 1:30 a.m. Sunday at a Frecker Drive home in St. John’s.

They say a tip from the public led officers to the home, where an arrest warrant was executed against Leyte in relation to a charge of fraud over $5,000 laid in Corner Brook. 
Leyte, originally from Corner Brook, was presumed dead after he went missing on Aug. 18, 2006.

A suicide note was found in his abandoned truck near the Humber River the day he went missing.

It’s not known whether Leyte was ever living in British Columbia, but police officials say he was living and working in St. John’s at the time of his arrest.  Sunday morning in provincial court, Judge Jacqueline Jenkins, presiding via teleconference from her bench in Stephenville read the single charge of fraud over $5,000 to Leyte.

The charge is in relation to an incident on July 14, 2006. Leyte was then remanded into custody for a bail hearing Tuesday in Corner Brook, where the charge was originally laid.
In June 2006, Leyte was sentenced to pay a $60,000 fine after being found guilty of tax evasion in May 2006. Leyte, a director of J.C. Bakery Enterprises Ltd., had pleaded guilty to five charges of making false statements on its GSThe charge is in relation to an incident on July 14, 2006.

Leyte was then remanded into custody for a bail hearing Tuesday in Corner Brook, where the charge was originally laid.

In June 2006, Leyte was sentenced to pay a $60,000 fine after being found guilty of tax evasion in May 2006. Leyte, a director of J.C. Bakery Enterprises Ltd., had pleaded guilty to five charges of making false statements on its GST and HST returns in the years 2001, 2002 and 2003.

Leyte was given 60 months to pay that fine, but disappeared two months later.
Meanwhile, there had been a number of unconfirmed sightings of Leyte since his disappearance, including aboard the Marine Atlantic ferry the day after his abandoned truck was discovered and in October in St. John’s.

At the time of his disappearance, the RCMP carried out search of the river and Bay of Islands area. Leyte was declared a missing person by the RCMP because a body was never found.

It’s not known if the RCMP will be laying charges against Leyte in relation to his disappearance, but an investigation is ongoing.

In similar cases in the past people have been charged with public mischief, but there is no indication that would be the charge that Leyte would face.

He just took off, left his employees and even worse, his family behind to suffer. I think this guy should be made to pay. I agree that there are bigger crooks, but a law is a law and anyone who breaks them should be prosecuted. End of story.

I think he should be forced to work off/pay off his debt to all he has cheated....my point is nobody benefits by imprisoning this man in our already overcrowded system while alleged baby killers and sexual deviants are out on bail. Stick an ankle bracelet on him for the time being and let justice take its course. if hes guilty, let him get what he deserves...but let the punishment fit the crime...lets see what sentences bob garland and jeff tippet get if they are found guilty and then compare it to what this guy gets if he is found guilty.

Just curious from NL writes: I am certainly not saying that he does not deserve to pay his share of taxes but I thought I'd put it out there for all of us to question.
Isn't paying taxes supposed to be volluntary? Do they have the right to make citizens pay taxes? I know one thing for sure, if you do your tax application and forget to sign it, they'll send it back to you to sign because they can't legally call it tax fraud unless you sign and agree with intent to pay. Of course once you sign, and do not pay, your butt will get hauled off to jail. Anyone else got feedback on our tax system. I personally have no problem with paying a tax of my own choosing since it's supposed to be volluntary. I am not a tax lawyer but am open to learn more. Thanks.

It's just as MKennedy says, the real criminals get the a slap on the wrist and the people who rip off the government get the shaft bigtime. It's as if they're saying, you can assault, rape even kill and we'll bend over backwards to let you off as leniently as we can, but don't ever rip us off. If you do, we'll come down on you like a ton of bricks. Anyone who sees that as OK is sucking up to government in my humble opinion. WTG MKennedy. You got it right..

Now, to M Kennedy- you make a serious allegation that staff at the city of Corner Brook are cheating people out of their money illegally (your term- crook). Would you please go to the police with your allegations? That is also your right as a citizen, especially when it comes to the public purse. If this is in fact happening, and it very well could be, I'd love to see it get fixed.

Someone asked the general comment board, I provided the information. You could have easily helped him out, but you chose not to.

As for the amount of time on my hands, I'm on day 8 of a 14 day straight work schedule and take breaks to compensate for this.

BTW- I work in an area where I am frequently on the Gov of Canada Website...I'm there enough that I knew exactly where in the site to find the answer to 'just curious' question and typed the link for CRA without the help of google.

Maybe you are just in a really foul mood lately, but I (as well as others) do think your attacks on either the story or the commenters are uncalled for 99 percent of the time. It's sad that for someone (and by soeone I mean you, Rumps) who professes he knows of the law had nothing helpful to say on this article or the other legal situations this past weekend. What exactly is your contribution to the comment boards? Some people may question my comments but at least I have the decency to back it up if needed or help someone out who is asking a question. You, Rumps, follow one of three threads- attack the subject of the story, attack the writing style, or attack the commenters. If you can't find something wrong with a story then you go after the commenters. Show me I am wrong. I don't actually recall you making a valuable comment in a while. I actually liked your comments, back a few months before your hiatus, but you have taken a turn and a bad one at that. Perhaps 'just curious' was having a hard time googling it, so I helped him. Apparently the only thing you would agree with is if I said 'non story' and 'waste of writing talent' and on and on. You pointing out the redundancies in stories- is getting a slight bit ...ahem...redundant. Maybe if you put some thought in your comments and made the effort to write something worthwhile you may feel nicer about yourself.

To everyone else who reads these comments, sorry that I had to waste a comment by having my say wrt Rumps comment. You guys may think I am also attacking, but I have way more respect for myself than to sit quiet.

Oh, and I purposely riddled one of the paras above with redundancies...just for fun.

Sorry he ripped off your parents in bc. I'm sure that isn't the first couple he's ripped off. There's nothing lower than someone ripping off people, and as a taxpaper ripping off the government that isn't ok either - when anyone rips of any type of agencies, we know they have no ethics and they'll probably end up ripping off other people. We pay the price when scam artists don't get punished especially as taxpayers, it's like the shoplifters we pay the price by paying higher prices.
CBGirl I liked your statement. Rump sounds like an idiot. The bail hearing should be interesting. The fact he tried to hide in St. John's is actually funny. It not only shows he's a con-artist but he's stupid too. Lot's of people from his home town and Corner Brook go to St. John's.
