The arrest warrant issued for Herbert Penney-Flynn in provincial court in Corner Brook Tuesday has been vacated.
The 73-year-old, who currently resides in Toronto, is accused of multiple sex offences alleged to have happened in Corner Brook in the 1980s.
The offences, alleged to have taken place in 1982 and 1988, involve two male victims.

The offences from 1982 include indecent assault, buggery, gross indecency, administering a noxious substance with the intent to aggrieve or annoy and administering a stupefying or overpowering drug with the intent to commit an indictable offence.
The charge from 1988 alleges a single count of sexual assault against a second male.
Judge Catherine Allen-Westby had issued the arrest warrant for Penney-Flynn when he was not present for his first appearance on the charges Tuesday morning. At the time, no lawyer was in court to represent him and there had been no indication of any communication from Penney-Flynn explaining his absence.
Later Tuesday, the case was called again after the courts did receive communication from Penney-Flynn.
The arrest warrant was vacated and he now has his next court appearance scheduled for May 15.
