Nicholas Shears-Decker was the driver of the vehicle involved in the single-vehicle crash that resulted in the death of 20-year-old David Dwayne White, who was also from the same area.
The Royal Canadian Mounted Police in Rocky Harbour say the accident occurred at about 11:15 p.m.
The vehicle with four occupants had gone off the road into the westbound ditch.
White was pronounced dead at the scene by paramedics and the other two passengers, a man and a woman, were taken to Bonne Bay Health Centre in Norris Point with non-life threatening injuries.
Shears-Decker was not injured in the accident. Besides the impaired driving causing death charge he’s also charged with failure to provide a breath sample and two counts of impaired driving causing bodily harm.
He was released on an undertaking that includes that he not possess or consume alcohol or enter a licensed establishment where alcohol is served.
He also has to report to the Royal Newfoundland Constabulary in Mount Pearl every Friday in person or by phone when in Rocky Harbour, must abide by a curfew between 11 p.m. and 6 a.m. everyday and surrender his drivers licence. He’s also not to have any contact with the man and woman injured in the crash.
His next court appearance was set for Nov. 15 in Rocky Harbour.
The RCMP is continuing its investigation into the accident and a collision analyst was at the scene on Monday.
