Trevor Wheeler contesting Crown’s vulnerable witness application

Trevor Ralas Wheeler is contesting an application by the Crown to have his alleged victim testify by close circuit television or behind a screen.

Wheeler, 31, of Irishtown-Summerside is accused of breaking into the woman’s apartment in November 2014. It’s alleged he damaged the door to the residence and harassed her in such a way that it caused her to fear for her safety.

It’s because of that fear that the Crown is asking that she be able to testify in a way in which she won’t see Wheeler.

During an appearance in provincial court in Corner Brook on Wednesday, legal aid lawyer Gary Kearney, acting on behalf of Wheeler’s lawyer Brian Dunphy, told the court that he was opposed to the application and asked that a hearing on the request be heard on March 8 prior to the start of his trial. Wheeler has pleaded not guilty to charges of break and entry with intent to commit an offence, criminal harassment, mischief related to property and breach of probation.

Crown attorney Adam Sparkes told Judge Kymil Howe that he had no issue with having the hearing, but he felt doing so at the start of trial was not a good idea.

He said it was a vulnerable witness application and for the woman to come to court not knowing the outcome could be distressing.

Howe agreed with Sparkes and set the hearing to Feb. 28.
