Convicted Corner Brook cop Sean Kelly pleads not guilty to second indecent phone calls charge

Sean Joseph Kelly, who is currently serving a prison sentence for making an indecent phone call, has pleaded not guilty to a second such charge.

The former Royal Newfoundland Constabulary officer based in Corner Brook was initially convicted of the first offence, along with a charge of mischief for diverting suspicion towards an innocent person, in February 2015.

The charges relate to a sexually explicit calls Kelly made to a woman in Corner Brook in October 2012 and his attempt to blame the calls on a potential police informant Kelly said he had loaned his police-issued cell phone to.

He was sentenced to 10 months in prison, but serving the sentence was put on hold while he appealed both the conviction and the sentence. He lost his first appeal in the Supreme Court of Newfoundland and Labrador in September 2017 and lost a second one in the Newfoundland and Labrador Court of Appeal last month.

The second charge of making an indecent phone call alleges Kelly called another woman in March 2013.

The prosecution of that charge had been delayed, at the defence’s request, pending the outcome of the Court of Appeal decision.

The matter was called in provincial court Tuesday morning for the first time since the decision was released last decision.

Kelly’s lawyer, Robby Ash, entered the not guilty plea and a three-day trial has been set for Nov. 18-20.
