CORNER BROOK, N.L. — An assault charge filed against minor hockey coach Jamie Brake was dismissed in Corner Brook provincial court today.
Brake, 43, was not in the court when the matter was called.
He pleaded not guilty to the charge during a previous appearance in June and his trial had been set for Nov. 25. Crown attorney Trina Simms said the matter was brought forward because the Crown would not be calling any evidence in the case.
She said in reviewing the witness statements and speaking with the alleged victim there was no likelihood of a conviction.
That left Brake’s counsel to put forward a motion for dismissal which Judge Kari Ann Pike granted.
After the appearance, Simms said the Crown’s office conducts a critical review of every file to determine if it could lead to a conviction.
Brake, who is also the mayor of Meadows, was charged in April following an investigation by the Royal Newfoundland Constabulary.
It had been alleged he was one of two men involved in an altercation in the parking lot of the Corner Brook Civic Centre on March 5.
At the time, Brake had been the coach of the Corner Brook Minor Hockey Association’s Corner Brook Royals bantam all-star team. He was suspended by the association pending the outcome of the case.
