Stephenville man to serve remainder of sentence conditionally

STEPHENVILLE, N.L. — Judge Lynn E. Cole told a 33-year-old Stephenville man on Thursday that the sentence and strict conditions she was placing on him was because of his actions involving an assault forcible confinement.

He said he understood and that he also understood her warning that he could end up incarcerated if he broke any of the conditions while serving out a conditional sentence or probation placed on him.

In court last week Cole sentenced the man to a total of 180 days in prison, including 30 days for assault; 120 days for being unlawfully in a dwelling house; and 180 days for forcible confinement.

All three sentences were concurrent and will be followed by a two-year probationary period.

The man has been in custody since his arrest on Jan. 12 of this year and Cole gave him a credit of 1.5 days for each day served in prison.

She said the remaining 34 days would be served on a conditional sentence order but warned him this is very much a jail sentence as the conditions must be strictly adhered to as outlined.

The man was originally facing more serious charges, including attempted murder and attempting to suffocate. Those two, along with two others (damage to property and uttering threats) were dropped in Stephenville Provincial Court in late March.

Then in court last week, Cole dismissed two more charges, including theft of a phone and break and enter.

Conditions of his sentence order include that he must keep the peace and be of good behaviour, report to court as asked, stay in his apartment except for set times, remain in the province, notify his probation officer of any change of name or address, attend anger management and/or control counselling as assigned by supervisor, present himself at the door or on a landline telephone when called upon, abstain from alcohol or intoxicating substances, expect for prescribed medications, not have contact or communicate with the victim and stay away from where she resides, works or attends school, provide a bodily substance when demanded and submit to a breathalyzer if requested.

A mandatory 10-year firearms prohibition was also placed on the man.

Many of these conditions are also in force during his two-year probation period.

He was also ordered to provide a DNA sample.

Cole said these conditions are to try and help the man in his rehabilitation.

“I encourage you to be the kind of partner that would wish for your children to be,” Cole said.

A publication ban is in place on any information that could lead to the identity of the victim.
