ST. JOHN'S, N.L. — Two companies and an individual are scheduled to make an appearance in provincial court in Clarenville next month on charges related to a fatal accident near Come By Chance two years ago.
Newfoundland and Labrador Hydro, Forbes Bros. Ltd. and a supervisor with the latter company have been charged with multiple violations of the province's Occupational Health and Safety Act in connection with the deaths of two men who were working on a new power line from Bay D'espoir to the Avalon Peninsula.
Jared Moffatt, 34, of Saskatchewan and Tim McLean, 31, of Ontario were killed June 19, 2017, when the transmission tower they were erecting fell to the ground. The men were employees of Forbes Bros., which had been contracted by Newfoundland and Labrador Hydro.
Work on the transmission line was halted as occupational health and safety investigators examined the scene.
Forbes Bros. has been charged with seven health and safety violations: failing to ensure the health and safety of its workers; failing to provide necessary information, instruction, training and supervision to its workers; failing to ensure workers and supervisors were aware of hazards; failing to protect those not in their employ; failing to include written work procedures appropriate to the hazards in its occupational health and safety program; failing to ensure working procedures promoted the safe interaction of workers and their environment; and failing to ensure written rescue procedures were implemented.
Newfoundland and Labrador Hydro has been charged with failing to ensure that an employer and workers complied with health and safety regulations.
A Forbes Bros. supervisor, who has not yet been named, has been charged with failing to ensure the health, safety and welfare of workers under his supervision.
All three are scheduled to make their first appearance in provincial court in Clarenville on July 4.
