Fanika Rostas, 22, of Ontario and Ludovic Sava, 21, of Quebec appeared in provincial court on Friday for a bail hearing.
However, the lack of a Romanian interpreter prevented that from happening.
Legal aid duty counsel Peter Chaffey told Judge Kymil Howe that Sava would prefer to have the hearing in Romanian, but if that was not possible he was prepared to proceed in English.
Rostas had the same first preference, but was agreeable to having the hearing in French.
Of the two Sava is the most proficient in English. Legal aid lawyer Sandi MacKinnon was able to provide some assistance in French to Rostas during the appearance.
Howe told them the court does not have a legal obligation to hold the hearing in Romanian and that there would not be a full trial in Romanian.
But she said the court will continue to search for a Romanian interpreter and if one was not available it will have a French one there for the bail hearing, which has been set for May 25 at 9:30 a.m. The bail hearing is expected to take a full day as the Crown has video evidence that will take some time to view.
The two men and a 16-year-old boy were arrested at the Marine Atlantic ferry terminal in Port aux Basques on May 13 and charged with the May 11 theft.
The 16-year-old from Quebec has been released on a $6,000 cash deposit and a $1,000 surety and is due back in youth court on June 21.
The three are also facing charges related to thefts in Grand Falls-Windsor and Mount Pearl.
